Are e-cigarettes banned from October 2021?
Answer updated 28 April 2023.
The short answer is, no. Non-nicotine electronic cigarettes (e-cigarettes) will still be legal to purchase or import and use within Australia (as long as it is legal in your state/territory - see our Australian vape laws page). However, we must take care as e-liquids or e-cigarettes that have warning labels saying they contain nicotine when in fact they don't, may be stopped at customs.
Pre-filled, disposable vape kits with nicotine are illegal to import and sell if you are not a pharmacist.
From October 2021, purchasing nicotine, nicotine e-liquid or pre-filled nicotine e-cigarettes (aka nicotine vaping products [NVPs]) domestically or internationally will require a doctor's prescription. You can find out more on the Therapeutic Goods Administration (TGA) website, such as:
- nicotine e-cigarettes law/regulations
- information for medical practitioners (prescribers) on how to access nicotine for patients
- guidance for use of NVPs and clinical guidelines for prescribers including results of some studies
- information for pharmacists regarding sourcing and dispensing nicotine vaping products.
The Australian Tobacco Harm Reductions Association (ATHRA) also has more information, including:
- a break-down of Australian and state vape laws
- a health professionals portal that requires a login with information about vape laws and prescriptions.
The new law does not effect our buying and selling non-nicotine e-cigarettes and e-liquids (which is what we do) so as long as we are still allowed to do that, we will be open for business for all our customers.
How do I return a product?
We organise all your returns for products we supply so you don't have to go to the manufacturer. Please note that we deal with you as our wholesale customer and not directly with your customers.
If one of your customers returns a product, feel free to follow your own store return policies. Before you do, please read our warranty and return terms to ensure the issue is covered under warranty if you'd like an exchange on that product from us.
Don't forget, contact us anytime if you have any questions.
What about liquid nicotine?
Nicotine seems to be the most discussed topic regarding the safety of e-cigarettes. We do not sell products with nicotine as it is illegal to sell within Australia.
If you have any questions or your customers ask you about purchasing nicotine, please refer to your relevant state laws/regulations.
Also, the Australian Tobacco Harm Reduction Association (ATHRA), a registered charity formed in 2017 by four independent medical practitioners, has interesting information about liquid nicotine and e-cigarettes.
